Registration and deregistration of a person with a disability has a number of features. If a disabled person moves independently and fully serves himself, then he can contact the FMS and be discharged. Persons under guardianship can be discharged by guardians or legal representatives.

In order to discharge a disabled person who cannot move independently and has a guardian appointed by the guardianship and guardianship authorities at the request of the disabled person or in court, the guardian must apply to the FMS.
You will need to present an application, a certificate or a certificate from the guardianship and guardianship authorities about the appointment of a guardian, a certificate of disability, your passport and the person being discharged. On the basis of the submitted documents, an authorized employee of the territorial migration service will deregister, issue a departure sheet and put a stamp in the passport.
If a disabled person does not have a guardian, he can apply to the FMS on his own or issue a notarized power of attorney to any person who is ready to assume his powers. On the basis of a power of attorney, a disabled person can be discharged without his personal presence.
If a disputable situation arises when a disabled person is not the owner of a home, does not live in an apartment, is missing, or his permanent place of residence is another living space, but at the same time he is not discharged from your home, apply to the arbitration court.
Disabled or partially capable persons are under the tutelage of the state, therefore, representatives from the guardianship and guardianship authorities must be present when the case is considered in court and when a court decision is made. If deregistration violates the rights of an incapacitated or handicapped citizen, you will not be able to receive a positive decision on compulsory discharge.
If the court made a positive decision, on the basis of the decision, you will be able to remove the disabled person from registration. To do this, contact the territorial service of the FMS with an application and a court order.
